KasPay – Terms of Service

Effective Date: July 2025

IMPORTANT: Please read these Terms of Service (“Terms”) carefully before using the KasPay wallet and platform. By accessing or using KasPay, you fully accept and agree to these Terms. If you do not agree, you must not use KasPay.

1. Non-Custodial Nature & No Key Storage

• KasPay is a 100% non-custodial wallet. You and only you control your private key and funds. KasPay never stores, has access to, or can recover your private key, your 4-digit PIN, or your recovery data under any circumstances.
• If you lose your private key, your funds are permanently and irretrievably lost. No one, including KasPay, can recover or access your assets.
• If any third party obtains your private key or 4-digit PIN, they can and likely will access and steal all your assets. It is solely your responsibility to keep your private key and PIN secure and confidential at all times.
• If you forget your 4-digit PIN, there is NO way to recover your PIN, access your encrypted wallet, or restore your assets. KasPay cannot, does not, and will not provide any recovery service.
• You are responsible for securely backing up your private key, PIN, and any backup information. KasPay recommends you store your backup physically, in a secure offline location, and never share it with anyone.

2. No Liability Under Any Circumstances

• KasPay and its owners, developers, partners, affiliates, and licensors are not liable for ANY damages or losses, including but not limited to loss of funds, profit, business interruption, data loss, unauthorized access, or any other negative consequence, whether direct or indirect, arising from your use of, or inability to use, KasPay under ANY circumstances whatsoever.
• This no-liability clause applies to all situations, including but not limited to: software bugs, security vulnerabilities, hacking, malware, hardware or software failure, user error, phishing, social engineering, device theft, or any other cause.
• You expressly agree that your use of KasPay is at your own sole risk. KasPay is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, either expressed or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.
• You agree to indemnify and hold harmless KasPay and all related parties from any and all claims, liabilities, losses, or expenses arising from your use of the service or violation of these terms.
• KasPay does not guarantee that the service will function without interruption, be secure, or be free of errors or viruses. You are solely responsible for maintaining the security and integrity of your device(s).

3. User Responsibility & Legal Compliance

• It is your sole responsibility to comply with all applicable laws and regulations, both in Sweden (where KasPay operates) and in any other jurisdiction in which you reside or access the service. If your local laws prohibit the use of KasPay, you must not use it.
• You must ensure you are legally allowed to use cryptocurrency services and KasPay in your country, state, or region. If any doubt exists, consult a qualified legal professional.
• You agree that you are solely responsible for the security of your device, operating system, browsers, and any software used in conjunction with KasPay.
• You agree not to use KasPay for any illegal, unauthorized, or prohibited activity, including but not limited to money laundering, terrorism financing, fraud, hacking, or the purchase or sale of prohibited items or services.
• If you are subject to regulations (including KYC, tax, or reporting obligations), you are solely responsible for fulfilling these. KasPay does not provide tax, legal, or regulatory advice.
• You understand and agree that by using KasPay, you waive the right to participate in any class action lawsuit, arbitration, or group claim against KasPay or its affiliates under any jurisdiction.

4. Privacy & Data

• KasPay aims to collect and store as little personal information as possible. Only your email address and Kaspa wallet address are stored for basic account operations.
• No private key, PIN, password, seed phrase, or sensitive authentication data is ever transmitted to, stored by, or accessible to KasPay or its operators in any way, at any time, for any reason.
• KasPay cannot, will not, and does not track your transactions, balances, or activity beyond what is strictly necessary for functionality and compliance with Swedish law.

5. Third-Party Services & No Guarantee

• KasPay may provide access to third-party services (such as Alchemy Pay for fiat on/off ramp, or others). KasPay is not responsible for the functionality, reliability, security, or compliance of any third-party service or integration.
• All risk of using third-party services is solely yours. You must comply with their terms and KYC requirements independently of KasPay.
• KasPay makes no representation or guarantee regarding the value, stability, legality, or functionality of the Kaspa blockchain or any integrated service.

6. Service Changes, Beta, and Reset Rights

• KasPay is in alpha/beta. Features may change, accounts and balances may be reset, and the service may be discontinued, suspended, or modified at any time, with or without notice.
• You agree that KasPay is not liable for any loss or consequence as a result of downtime, resets, upgrades, or termination of service.
• Continued use after any changes to these terms constitutes acceptance of the new terms. Material changes will be posted here.

7. Jurisdiction & Governing Law

• KasPay is operated in Sweden and is governed solely by the laws of Sweden, without regard to conflict of laws principles.
• Any disputes, claims, or legal actions arising from your use of KasPay must be brought exclusively in the courts of Sweden.
• If any part of these terms is found invalid or unenforceable, the remainder will remain in full force.

8. Acceptance & Final Acknowledgement

• By creating an account, accessing, or using KasPay in any way, you affirm that you have read, understood, and agree to be bound by these Terms of Service.
• You acknowledge that you are solely and fully responsible for your own actions, decisions, and security regarding the use of KasPay, and that you use the software and all services entirely at your own risk.
• If you do not agree with any of these terms, do not use KasPay.
